If someone you love is detained by ICE right now, a legal battle over whether they have the right to request bond is being fought in federal courts and the outcome could determine whether they stay locked up or come home 🚨 Kyle Cheney of Politico reported that a federal judge in New Jersey became the first to directly address the recent Fifth Circuit decision on whether immigrants detained by ICE have the right to a bond hearing. The Fifth Circuit recently determined that those who entered the United States without a visa, were then released inside the country and lived here before being arrested again by ICE, do not have the right to bond and must remain detained throughout their entire immigration process. This decision was a drastic break from approximately 300 federal district judges who ruled the opposite. But the Fifth Circuit decision is binding in Texas, Louisiana, and Mississippi, where many of the Trump administration's detentions are happening. In those states, not even a habeas corpus lawsuit can free someone ⚖️ The New Jersey judge said she was not convinced by the Fifth Circuit's reasoning. That indicates the court hasn't changed many minds it seems and its interpretation won't be adopted nationwide until the Supreme Court addresses this. The law remains divided. If you're detained in Texas, Louisiana, or Mississippi, the Fifth Circuit decision works against you. Practically everywhere else in the country, hundreds of judges believe the law requires at least an opportunity to argue for your release 💪 That's why this is urgent. If a loved one is detained, you need to speak with an immigration attorney immediately. A habeas corpus lawsuit will probably work outside of those three states, but it won't work once they transfer them there. The government knows this and is going to try to move detainees to those jurisdictions to avoid having to release them through habeas corpus. So don't wait.
