The merits hearing, also called the individual hearing, is adversarial by design. There is a prosecutor in the courtroom, an attorney for ICE, whose job is to convince the judge to deport you and argue that you are not credible. 🚨 If you walk in believing the truth will speak for itself, you are walking into a system built to challenge every part of your testimony. First, the judge questions you. You do not get to tell your story in one uninterrupted narrative. The judge asks question after question, changes topics constantly, interrupts you, and jumps around in time until you feel completely disoriented. That pressure is intentional. Then, after the judge finishes, the ICE attorney begins asking even tougher questions designed to break apart your case. But this changes when you have proper preparation and legal representation.
