USCIS recently made two announcements that could affect your asylum case, depending on where you are in the process. Today, I want to focus on people who haven’t applied yet and people with a case already pending. ⚖️ If you haven’t applied yet, USCIS can review your file based on what’s there when they receive it. If it’s incomplete or doesn’t show that you could qualify for asylum, your case could be referred straight to immigration court without an interview. So if you’re planning to file, build your case completely before you submit it. Your declaration, evidence, legal brief, and country conditions reports should all be in the file from day one. 📝 If your case is already pending, these changes aren’t limited to new filings. If you filed your I-589 years ago with just the basic form and planned to add evidence before your interview, your case could be at risk too. USCIS could review your file and, if it determines that it’s incomplete or doesn’t show that you could qualify for asylum, you might not get an interview at all. You could be referred straight to deportation proceedings. 🚨 And I want to be clear: USCIS has not said that it’s too late to add documents to a pending case. If your case is pending, update your file now with strong supporting documents and make sure everything is well organized before an officer reviews it.
