On January 14, 1639, delegates from three New England towns created the first written constitution in what would later be the United States, the Fundamental Orders of Connecticut.
It points forward to the formation of state constitutions, then the Articles of Confederation and the United States Constitution, by representatives of a sovereign people. But it also, crucially, points backward, to the British habit of formally limiting what government could do to the people that is reflected in Magna Carta and that reflects not a bargain between citizens and the state but an agreement among citizens about government.
