A Northern District of Florida judge rejected the state's request to dismiss the suit of six students from Florida A&M filed in September. The lawsuit names the state of Florida; the State University System's board of governors and its chancellor, Ray Rodrigues; the State Board of Education and its commissioner, Manny Diaz Jr.; and Republican Gov. Ron DeSantis as defendants.
The plaintiffs demand that the state commit to equity in its support of HBCUs and seek injunctive relief under Title VI of the 1964 Civil Rights Act. The complaint shows a 1.3 billion dollar discrepancy in funding received compared to the University of Florida from 1987 to 2020.
A 2022 study by Forbes found that Florida A&M received $2,600 less per student than the University of Florida in 2020.
