Ghost guns are kits allowing users to assemble fully functional firearms without serial numbers or background checks. The order, passed with a 5-4 vote, permits regulations to persist during ongoing legal challenges. Chief Justice John Roberts and conservative Justice Amy Coney Barrett joined three liberal justices in favor, while Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh dissented. The Bureau of Alcohol, Tobacco, Firearms and Explosives updated its regulations in 2022 to categorize these kits as firearms, facilitating better tracking. This rule doesn't ban their sale or possession but requires adherence to federal laws governing the commercial sale of firearms, aiming to enhance traceability. The challenge was initiated by two Texas residents intending to manufacture ghost guns from components, and retailers of ghost gun kits also participated in the challenge, asserting that the ATF overstepped its authority in defining firearms.
