Sam is joined by Jeff Gaddy who shares about his ongoing mass tort case against major social media companies including Meta, Snap, Google, and ByteDance (TikTok), and their platforms’ exploitation of minors via overwhelming exposure to addictive and harmful content. Gaddy walks through these corporations’ responsibility for the design and development of their platforms, touching on the protections from liability for true third-party content that Section 230 offers and the exceptions to these protections when it comes to these corporations’ production of their own (even if derivative) content and to how said design and development curates and highlights the content users engage with. After running through various other ongoing cases against these companies, Jeff and Sam unpack the developing role of legislative challenges to these practices and the importance of civil law in pushing these issues into the open, wrapping up the interview by briefly touching on the major revelations in discovery and what the “damages” of this exploitation look like.
