There is a sort of civic religion in the country that lionizes the framers of the Constitution and the document itself. In Allow Me To Retort: A Black Guy’s Guide to the Constitution, Elie Mystal takes issue with this viewpoint, and in a wide-ranging discussion Harry and he take up a number of what he sees as integral flaws, starting with the notorious 3/5 compromise that determined that 3/5 of the South’s slave population would be counted for representation in the House. Mystal is ultimately a believer in the legal system and the current text of the Constitution but perceives numerous ways in which the Supreme Court’s jurisprudence undermines the promise of equality and due process in the post Civil War Amendments.
