as posted by the channelA week or two ago, while guesting on Rekieta Law during our relentless and arduous coverage of the Alex Murdaugh trial, news broke that #alecbaldwin had been relieved of the sentencing enhancement charge that the NM prosecutor had brought against him on top of the involuntary manslaughter charge.
I had taken a quick look at the relevant law just before coming onto Rekieta Law, and while waiting for the Murdaugh trial to start up I opined that it seemed to me that the enhancement certainly should have been dismissed as against armorer Hannah Guttierez-Reed, but that dismissing the enhancement against Baldwin did not seem legally necessay.
I. WAS. WRONG! I meant to get to this earlier, but it's been hell catching up on stuff since Murdaugh's conviction. In any case, I'm here today to shout my "mea culpa," and share the history of the sentencing enhancement statute that made this a messy affair.
