27:50Now PlayingIn today's show Attorney Andrew Branca shares the SECOND of a FOUR-PART reading of the 2008 US Supreme Court decision of "DC v. Heller."
"Heller" is the seminal Supreme Court decision written by the brilliant (now deceased) Justice Antonin Scalia, finding that the Second Amendment right to keep and bear arms is an INDIVIDUAL right, and not merely a "right" of some government militia, and thus not subject to whimsical infringement by the Federal government.
As a result, the then-existing laws of the District of Columbia (effectively, the Federal government) prohibiting the ownership by American citizens of handguns in the home was deemed unconstitutional.
This reading of "Heller" will occur over four parts, published over the next several days. THIS IS THE SECOND OF FOUR PARTS. Note that I am reading ONLY Justice Scalia's majority opinion, and not any dissent.
After "Heller," I will also do readings of the two other seminal Second Amendment decisions from the US Supreme Court, "McDonald v. Chicago" (2010) (majority only) and "New York State Rifle & Pistol Assoc. v. Bruen" (2022) (entire decision).
