as posted by the channelEarlier this week I read the 71-page decision of Judge Roger Benitez, a Federal trial court judge, in holding (FOR THE SECOND TIME) that California's standard-capacity magazine violates the Second Amendment.
Obviously, the gun controllers are losing their minds over this decision, and so it was well-anticipated that the California Attorney General, Bonta, would appeal the ruling to the 9th Circuit.
Instead of following normal 9th Circuit procedure and have the matter proceed to a 3-judge appellate court, however--where the mag ban had PREVIOUSLY been found unconstitutional, only to be reversed by an en banc panel of the 9th--the 9th circuit has decided today (Sept. 28), to by-pass normal procedure and go straight to en banc.
Reversing 2A-favorable trial court and 3-panel appellate court rulings is a favored practice of the 9th Circuit, and reliably results in pro-2A rulings being overturned, usually in decisions that can only be described as irrational word salad.
Interestingly, there were several dissents to this order taking the matter en banc, and THEY WERE ON FIRE!!!
