Judges just realized the trap they built for themselves.
If they block Trump from using Section 12406 to federalize the National Guard, his next lawful step is the Insurrection Act — which gives him even broader authority to restore order.
The Ninth Circuit lawyers quietly admitted it:
“If they tell Trump he can’t use 12406… he’ll have no choice but to invoke the Insurrection Act.”
And that terrifies them.
Because the Insurrection Act has no judicial review, no “emergency permission slips,” and no activist vetoes from the bench.
