The D.C. Circuit didn’t just stay the order — it all but ended the case. The panel flat-out warned the district judge that there is likely no Article III jurisdiction at all, because the District of Columbia lacks sovereign standing to sue the federal government. Translation: you may not even have the power to hear this case.
That’s constitutional bedrock. D.C. is a federal enclave, not a sovereign state. It cannot sue its own boss over Commander-in-Chief authority. The appeals court shredded the trial judge’s reasoning on command authority, federal law, and now standing — calling out errors that go to the very power of the court itself.
This wasn’t close.
When an appeals court tells a trial judge “fix this or we’ll reverse you again,” the writing is on the wall. Lawfare only works until the Constitution shows up.
