This dissent does something revolutionary: it reads the Constitution the way the Founders wrote it.
“We the People” was a term of art, not a feel-good slogan. It referred to the citizens who consented to be governed, who voted, served on juries, bore arms, and formed the political sovereign. Illegal aliens did none of that — and the Founders were explicit about the distinction.
From Madison to Hamilton to Washington’s Farewell Address, the historical record is overwhelming: the right to keep and bear arms belonged to citizens, because it was tied to self-government and resistance to tyranny. Aliens owed temporary obedience to the law — not allegiance, and not constitutional authority.
The majority dodges this history because it’s fatal to their case.
