Kagan argued the Court’s “emergency docket” is malfunctioning and that the Court moved too quickly instead of letting the appellate process play out.
But the majority’s view is simple:
Lower courts are issuing sweeping injunctions at an unprecedented rate — forcing the Supreme Court to step in.

• Whether schools can override First Amendment religious rights
Kagan argues the Court should have waited.
