as posted by the channelA group of more than 175 former federal and state judges has filed an amicus brief in a case before the Supreme Court arguing that lower courts are not necessarily bound by unexplained emergency orders issued by the Court. Their position is that when the Supreme Court issues a stay without a full written opinion, lower courts may treat those orders as non-binding when deciding similar cases.
The argument strikes at the core of the federal judicial hierarchy. In the American court system, authority flows from the Supreme Court downward to the appellate courts and then to the district courts. If lower courts were free to disregard Supreme Court orders simply because they dislike the reasoning—or because the Court did not provide enough explanation—the entire structure of judicial authority would begin to break down.
