Tomorrow the Supreme Court hears arguments in Trump v. Barbara, the case that could finally settle whether the 14th Amendment guarantees citizenship to every child born on U.S. soil -- regardless of whether their parents entered this country legally. I have been covering this issue for months, and his argument is straightforward: the Supreme Court has never actually held that the children of illegal aliens are citizens. The 1898 case everyone cites, Wong Kim Ark, involved the child of lawful permanent residents, not people who broke federal law to enter the country. Extending that ruling to cover illegal aliens isn't legal precedent -- it's a century of constitutional overreach.
The core legal question comes down to four words in the 14th Amendment: "subject to the jurisdiction." Courts have quietly redefined that phrase to mean little more than physical presence, but Branca argues the original meaning required full political allegiance -- the kind that illegal aliens, by definition, cannot offer. Tomorrow's argument is the first time the Supreme Court will confront this question head-on.
