Justice Ketanji Brown Jackson accused the Court of abandoning principle for political power after the majority removed the standard 32-day delay and allowed the ruling to take immediate effect before the midterms.
Justice Alito responded forcefully. He called Jackson’s accusations “groundless,” “irresponsible,” and suggested her position would effectively preserve unconstitutional districts by running out the election clock.
At the center of the fight is a deeper issue: whether courts should allow elections to proceed under maps already ruled unconstitutional simply because the election calendar has already begun.
