as posted by the channelThe Fifth Circuit Court of Appeals has paused the FDA’s Biden-era rule allowing abortion drugs to be prescribed online and shipped through the mail without an in-person doctor visit.
What makes this case especially damaging for the FDA is that the agency itself admitted the rule suffered from procedural defects and lacked adequate safety review.
Under the Administrative Procedure Act, agencies can’t simply bypass required analysis—especially on major policy changes affecting public health and state sovereignty.
The Fifth Circuit concluded Louisiana was likely to win on the merits and was suffering irreparable harm, while the lower court improperly focused on the least important legal factors to keep the rule in place.
