Alex Murdaugh has won a new trial in the murders of his wife Maggie and son Paul. Murdaugh is a contemptible human being. His admitted financial crimes — defrauding clients, stealing from a grieving family, betraying every duty an attorney owes — earn him every minute of the prison time those crimes carry. But that is not the same as murder.

On the murder charges, the State's case was almost entirely circumstantial: no eyewitnesses, no recovered murder weapons, no confession, and no forensic transfer linking him to the killings. To paper over those gaps, the prosecution flooded the trial with months of unrelated bad-character evidence about his financial misconduct — exactly the propensity evidence Rule 404(b) is meant to keep out. The jury didn't convict on proof of murder; it convicted on a man's reputation—a conviction further tainted by the self-serving, book-publishing shenanigans of court clerk Becky Hill, whose misconduct appears to have been the foundation for the South Carolina Supreme Court’s decision to overturn Murdaugh’s murder convictions.

Even the worst of us is entitled to due process and conviction only on proof beyond a reasonable doubt. That principle does not exist to protect Alex Murdaugh; it exists to protect every American who could one day stand accused.
