as posted by the channelThis past weekend, protesters surrounded and obstructed the Delaney ICE facility in Newark, New Jersey, interfering with federal immigration enforcement operations.
The legal authority to charge those individuals is clear: 18 USaC 111(a) makes it a federal crime to forcibly obstruct, impede, or interfere with federal officers performing their official duties. The statute carries real teeth—a 1 year sentence minimum, and up to 8 years of the obstruction involves contact. The question is why no one appears to be using it.
The federal government's failure to respond forcefully is not a minor oversight. Immigration enforcement is an exclusive federal function, and allowing organized obstruction to go uncharged sends a message that the law can be flouted without consequence. That is a dangerous precedent, and it is one the current administration has more than enough authority to correct.
At some point, someone in the federal government needs to act like an adult and enforce the law that is already on the books. We will break down exactly what happened in Newark, what the law requires, and what the absence of action tells us about where we actually stand.
