Just weeks after Louisiana v. Callais changed the legal standards governing race-based districting, a federal district court in Alabama attempted to reimpose a congressional map that the Supreme Court had already vacated.
Andrew Branca breaks down the unsigned Supreme Court order—likely authored by Justice Alito—and explains why the majority concluded Alabama is likely to win on the merits.
The Court held that the lower judges failed to follow Callais, ignored the presumption that legislatures act in good faith, disregarded legitimate political districting goals, and improperly interfered with election rules on the eve of an election.
The result is another major victory for race-neutral redistricting and another warning shot to lower federal courts that appear unwilling to follow the Supreme Court's new standards.
