12:04Now PlayingA Colorado police officer is facing murder and manslaughter charges after fatally shooting Rajan Stubblefield. Then you watch the video—and I think the prosecution becomes very difficult to understand.
In today's show, I walk through the footage showing Officer Charles Neely repeatedly backing away as Stubblefield advances toward him, while Stubblefield can be heard repeatedly directing his son to retrieve a firearm that had fallen to the ground. Neely continues retreating until he's being pushed toward the street, and only then does he fire. Based on the evidence shown here, I believe this looks like a straightforward use of deadly defensive force—not murder.
I also explain how prosecutors can obtain a grand jury indictment without necessarily presenting every piece of evidence favorable to the defense, and why Colorado's decision to eliminate qualified immunity for police officers matters far beyond this one case. We ask police officers to confront violent, noncompliant suspects on behalf of society. If every lawful use of force can destroy the officer's freedom, career, and finances, eventually nobody competent will want the job.
