26:33Now PlayingLindsay Clancy’s defense has now given the jury its final story, and the target is no longer just the prosecution’s evidence. Her lawyer goes after the doctors, the medications, the police investigation, the prosecution’s experts, the hospital care, and what he repeatedly calls manipulation. The message is unmistakable: Lindsay was failed, misunderstood, mistreated, and driven into catastrophe by forces around her.
I walk through the strongest and weakest parts of that closing. Some of the defense attacks are legitimate trial arguments. The prosecution’s theory did evolve. There are real questions about the investigation. And the evidence supports that Lindsay suffered from serious mental illness and made a genuine suicide attempt. But none of that automatically answers the legal question that matters. Was she unable to appreciate the wrongfulness of killing her children, or was she unable to control her conduct because of mental disease? That is where I believe the defense still has a serious problem.
The defense wants the jury focused on bad medicine, bad police work, bad experts, and a system that supposedly failed Lindsay Clancy. But a criminal trial is not a referendum on whether everyone around the defendant performed perfectly. The jury still has to decide whether Lindsay Clancy was legally insane when she killed her three children.
