This week, the January 6th Commission wrapped up its work in anticipation of a Republican controlled congress by formally referring former President Donald Trump to the Department of Justice for criminal prosecution on the following charges: “Obstructing an official proceeding,” “Defrauding the United States,” Making false statements, and the coup de grâce: “Assisting or aiding an insurrection.”
This doesn’t mean that Trump will absolutely be held criminally responsible, but it does make that possibility a reality. Previously, the committee had gone back and forth a number of times about whether they could refer Trump to the DOJ, but this week there were no more questions, just the facts of the case. It does not necessitate Merrick Garland to act, but he has appointed a special counsel which is a hopeful sign. If Trump can’t be held accountable for Jan 6th what does that say about our complicity with coup-like behavior?
