What important cases are coming up this Supreme Court term? As we enter season two of “spin a wheel and see what fundamental right you lose,” the Supreme Court is primed to have a busy and productive time. We were joined this week by Elie Mystal, Justice Correspondent for The Nation, to break down some of the issues up for review by the theocratic council.

One of the most important cases is Moore v. Harper, and the fundamental question up for debate is “independent state legislature” theory. According to SCOTUSblog “‘independent state legislature’ theory would give state legislatures broad power to regulate federal elections without interference from state courts.” The reason this is even at issue is the 2020 election, where Republicans attempted to install their own slate of electors who were completely divorced from the democratic voting process that had just occurred. This seems unlikely to pass, however the court may find an opportunity to take a potshot or two at voting rights. After all, many of the justices, like Chief Justice Roberts, and Justice Kavanaugh, were directly involved in the Bush team's legal argument that was predicated upon this very idea.
