Importantly, eight of the nine current Supreme Court justices went to Harvard or Yale for their Juris Doctor. Now, the Ivy Leaguers in their unelected ivory tower are at it again when they decided to strike down college affirmative action programs. In the Supreme Court’s decision in Students for Fair Admissions v. Harvard and Students for Fair Admissions v. University of North Carolina, the court ruled that race should not longer be considered as a factor in the admissions process.
As critics of affirmative action have pointed out that it’s true that after 25 years, affirmative action has not succeeded in ending discrimination, however, is that a reason to reverse course on diversity efforts all together? (Especially, when in the same week the court also undertook efforts to essentially make discrimination legal!)
Justice Sonia Sotomayor, who dissented, wrote that the court "stands in the way and rolls back decades of precedent and momentous progress." She also was criticized as a diversity pick, as was Judge Ketanji Brown Jackson, during their nominations to the high court. After the ruling Biden declared, that colleges and universities “should not abandon their commitment to ensure student bodies of diverse backgrounds and experience that reflect all of America.”
Now, following the decision, college admissions offices are left scratching their heads, wondering how to diversify their student body without stepping on any legal landmines. How do you think this play out and who will it benefit?
