Though lawmakers say it’s not a ban on the Chinese-owned app, last week the House passed a bill that would give ByteDance 180 days to “divest” from TikTok, voting in a dramatic 352 to 65 margin. Meanwhile, a day after the bill passed, former Treasury Secretary Steven Mnuchin said he'd gather a group of investors to try to buy the app. Bytedance has said clearly that it's not for sale.
Many are raising the question of why exactly the government is so concerned about TikTok and so-called Chinese surveillance now? In many ways TikTok does have extreme privacy concerns but perhaps not any moreso than Facebook or other US-based tech companies. The question then becomes what makes TikTok unique, its Chinese ownership and its user base.
Critics are saying that these efforts by the US government may harm free speech rather than protect users. “Banning TikTok, directly or indirectly, would violate the First Amendment because it would stifle free expression and restrict the public’s access to a critical source of information,” said senior staff attorney with the ACLU’s National Security Project.
