President Trump has defended an immigration policy known as "metering," which dates back to the Obama administration and was rescinded under former President Biden. Under the measure, border officials would turn back noncitizens before they could cross into the U.S.
Federal law only guarantees migrants who arrive in the U.S. the ability to apply for asylum. Trump, who expanded metering during his first term, is hoping to bring the practice back.
The oral arguments come as Trump prepares to swear-in Sen. Markwayne Mullin (R-Okla.) to lead the Department of Homeland Security after ousting DHS Secretary Kristi Noem earlier this month. Mullin's new role also comes as the White House and lawmakers battle over funding for the department amid the partial government shutdown.
