Comey case: Retired FBI official highlights challenges in proving false statements

More indictments against former administration officials are expected now that former FBI Director James Comey is facing federal charges.

During the weekend, President Donald Trump also mentioned former FBI Director Christopher Wray is also under a major federal investigation.

As for Comey, who was indicted on two counts of making false statements and obstruction of justice, retired FBI Special Agent in Charge Jody Weis said prosecutors need to prove that Comey knowingly and willfully made certain comments.

“It has to be material,” Weis said Tuesday during a one-on-one interview with The National News Desk’s Jan Jeffcoat. “What he said had to be consequential. Did it influence Congress’ decisions? So, you’ve got to look at it that way. We’ve all been through these Congressional hearings. Sometimes, the questions are more like statements, so were the questions clear that he answered?”

Weis went on to say another big issue is time.

“What did Comey know at the time he made those comments?” Weis said. “Did something happen after the fact that changed those? So, those are all things that the government’s going to have to put together for a solid case and they’re not easy. We’ll have to see how that plays out.”
