Continuance After Continuance After Continuance in the State of Indiana v Joshua Kimbrell - WHY?

The Political Spotlight brings the latest news in the State of Indiana v Joshua Kimbrell criminal case.

Kimbrell, a Winchester man, was arrested and jailed in the Randolph County jail on Friday, December 29, 2023, after he self-reported to Deputies of the Randolph County Sheriff's Department that he had been sexually molesting his step-daughters, who were under the age of 14 when it started! Kimbrell self-reported because he had been caught by his then-wife, and after an evening of arguing, he turned himself in on 12.29.23.

Kimbrell was formally charged a short time after the arrest by Randolph County Prosecutor David Daly. The extremely serious charges range from a LEVEL 1 FELONY to a LEVEL 3 FELONY and a couple LEVEL 4 FELONIES (Child Molesting - defendant is 21 years of age or older... & Child Molesting - fondling or touching a child under 14 years of age...) Kimbrell had victimized three young girls.

Kimbrell has been in the Randolph County jail since his arrest, having no way or no one to pay the $7,000 needed for his $70,000 bond.

At the time of the creation of this video, Kimbrell has been in jail, and his victims have been awaiting their day in court for over 378 days (a year plus). Kimbrell has been offered several different plea deals, having refused to take any of them. This is an open-and-shut case. The defendant self-reported his crimes to the police, so why has the case not moved forward with a plea deal? If he won't accept a plea, why has this case not gone to trial?

THAT IS A GOOD QUESTION!

The case has been continued three or four times over the last year. Two continuances ago, the special judge, Brian Bade (from Blackford County), told all parties there would be NO MORE CONTINUANCES! The jury trial was set for April 2024, but a few days before the trial was slated to start, Kimbrell's attorney asked for another continuance, which was granted! Then the trial was set for January 22nd, 23rd, & 24th, 2025. The judge told everyone there would be NO MORE DELAYS!

Then, during a final pre-trial conference in December 2024, Kimbrell's attorney informed the court that he could not attend on January 22, 2025. The court rearranged the calendar and reset the trial for January 23rd and 24th, 2025. The judge then told Kimbrell's attorney they had two weeks to come up with a plea deal or proceed with the trial. However, for some reason, he also said that if they needed a continuance, they would have to ask within those two weeks.

Then, on January 3, 2025, one day after the two weeks ended, Kimbrell himself - not his attorney, asked for a continuance from the court. And on Friday, January 10, 2025, the judge GRANTED THAT CONTINUANCE! PUSHING THE TRIAL DATES OUT UNTIL MAY 7th, 8th, and 9th, 2025.

THAT IS OUT OF CONTROL! THAT IS FOUR MONTHS OUT! WHY?

Judge Brian Bade is to blame!

Prosecutor David Daly is to blame!

Defence Attorney Sam Beasley is to blame!

And Joshua Kimbrell is to blame!

Kimbrell is just playing a game, and they are allowing it! WHY?
