On Friday, January 24, 2025, Bohacek was pulled over around 3:30 p.m. in Michigan City, Indiana, after a citizen called police dispatch reporting him as a possibly "intoxicated driver." The caller stated that Bohacek, who was unknown at the time of the call, had been at a Panda Express restaurant and appeared to be "highly intoxicated." The caller also advised that he got into a car and started driving.

The police pulled over the car, which had Indiana State-issued plates identifying the driver as a State Senator. When the officer approached Bohacek, it seemed that food was all over him, and he exhibited signs that he might be intoxicated.

It was reported that Bohacek refused the "breathalyzer" and was taken to the hospital, where a blood draw revealed a Blood Alcohol Content three times the legal limit. His BAC was .283%. The legal limit in the State of Indiana is .08%.

However, Bohacek was NOT ARRESTED; he was not formally charged, nor were his licenses suspended! BUT WHY? Because of a little-known law called "Legislative Immunity." In Indiana, Legislative Immunity protects lawmakers from being arrested, except for treason, felony, or breach of the peace, during legislative sessions, 15 days before and after the session, and while traveling to and from the Statehouse. ABSOLUTE INSANITY!

Sources have been reaching out since February 2025, trying to bring this information to the attention of anyone who would listen. The Political Spotlight heard rumblings from a source in northern Indiana that same month but didn't have enough to proceed. Finally, Host Kristopher H. Bilbrey gathered enough information to discuss the story on Wednesday, May 14, 2025. The story gained traction, becoming a statewide issue during the last weekend of May and the first week of June 2025. As a result, Bohacek has finally been charged with three misdemeanor counts, which are:

Count 1: (A Misdemeanor)

Operating a Vehicle with an Alcohol Concentration Equivalent to .15% or More...

Count 2: (A Misdemeanor)

Operating a Vehicle While Intoxicated Endangering a Person... (A Misdemeanor)

Count 3: (C Misdemeanor)

Operating a Vehicle While Intoxicated...
