3:36Now PlayingHost Kristopher H. Bilbrey calls out the members of the Muncie City Council during their regularly scheduled meeting on Monday, October 6, 2025, for holding an ILLEGAL "Closed-Door Meeting" just moments before the real meeting was to begin!
All nine councilors, Republicans and Democrats alike, met to decide how they would handle three Ordinances on the agenda, ahead of the actual meeting, which was set for just a few minutes later than the time they were meeting illegally.
Pursuant to Indiana’s Open Door Law (IC 5-14-1.5), a quorum of the council — which in Muncie's case means five or more members — may not convene privately to discuss public business or items that may come before the council. The law further prohibits any official action or deliberation outside of a properly noticed and open public meeting.
In this specific situation, 8 of the 9 councilors were present, with one attending via Zoom. They discussed an issue that should have been addressed at the public meeting. They decided how they would vote and what day they would hold a special meeting.
Once the actual meeting got started, Bilbrey called the councilors out, and they admitted they had, in fact, met; however, they claimed it was okay. Bilbrey advised that he would file a formal complaint with the Indiana Public Access Counselor to obtain a ruling on the matter.
Bilbrey filed that formal complaint on October 9, 2025.
