Donald Trump has made his campaign rhetoric very strong on the topic of torture and he is saying that they should 'torture even if it doesn't work'. This is absolutely ridiculous especially in the case of guantanamo bay because not only of the fact that American exceptionalism doesn't line up with imprisoning people into a prison in foreign land that does not provide the detainees with the right to a fair trial or the same rights as US citizens to prove their innocence, but the legality and constitutionality of Guantanamo Bay is non-existant. Under the constitution, habeus corpus is required, which is due process in which everyone must be taken to court and had a RIGHT TO A FAIR TRIAL. It is not guilty until proven innocent, it is innocent till proven guilty. The ICCPR requires certain rights given to war prisoners, as do the Geneva Conventions, which is International LAW. One of Obama's biggest failures is not closing down Guantanamo Bay, look what kind of a monster you left Guantanamo's hands in you fake.
