Thanks to an alert from Truth Social sent out to all users this week. Trump's supporters now are spreading the baseless conspiracy theory that special prosecutor Jack Smith is in fact seeking the death penalty against Donald Trump. I mean, look, we shouldn't rule anything out at this point, right? No, I'm, I'm totally kidding. Absolutely. This, these charges he's been hit with do not come with the death penalty. They can under certain circumstances, and I'll talk to, talk about that in just a moment. But truth, social actually sent an alert to users this week that said, quote, new charges against Trump carry death penalty. So this isn't just Trump supporters that have created this conspiracy theory that Jack Smith wants to put him in the electric chair Trump's own program, truth Social sent this out to people saying, Hey, they want, they want capital punishment for these crimes.
And again, that is just 100% not true. Of the four charges that Trump was hit with by Special prosecutor Jack Smith in this particular indictment, two of them carry a maximum prison sentence of 20 years. So that's 40. If he gets the maximum upon a conviction, a third charge carries a maximum of 10 years in prison. So we're up to 50 years. The fourth one carries a five year maximum prison sentence. So at most he could be looking at 55 years in jail, which considering his age is effectively a life sentence. It's not a death sentence, it is a life sentence.
But he's not gonna get hit with a maximum. I mean, nobody hardly ever gets hit with the maximum. So he's not gonna be hit with 55 years in prison. And of course, all of that hinges on whether or not they even convict him on all counts in the first place. So let's not count any of our chickens before they hatch. But here's the thing about the provision under wr, which he's charged under, which is section 2 41 of Title 18 of the US Code. Um, the punishment for violating this section, according to the Department of Justice is a felony. And up to 10 years in prison, the penalty can be extended to life in prison or death if the government proves an aggravated factors such as that the offense involved kidnapping, aggravated sexual abuse, or resulted in death per the Department of Justice. So Trump didn't kill anybody. He didn't kidnap anybody, and he didn't assault anybody. So they're not seeking the death penalty. But it doesn't matter. I mean, Dinesh Deza already like tweeted out after Truth Social, sent that out. Dinesh Deza said, uh, you know, this proves how scared they are
Of Trump. No, no, it doesn't. Nobody is afraid of Donald Trump. We're afraid of what he'd do if he had power again. But I'm not afraid of him running. I'm not afraid of him winning. I don't think that's a possibility. But even if it were a possibility, I wouldn't say that, oh, well then he should be hanged for his crimes. No, that's not a thing, that's crazy. Talk from crazy people. And the crazy people talking about it all happen to be the MAGA freaks. Jack Smith is not going to put Donald Trump to death if we get solid convictions on all four counts. He may spend the rest of his life behind bars, but they're not gonna be strapping him into the electric chair or holding him down for the lethal injection anytime ever.
