The Trump administration is proposing a new five thousand dollar apprehension fee for anyone detained by ICE, including people who are in the United States legally and following every rule of the immigration process. This would be the first time the government has ever charged people simply for being detained, and it would allow ICE to halt a person’s case until the fee is paid, which raises serious questions about due process, equal access and whether DHS even has the authority to create a payment tied to detention itself. Since many who would be affected are families, workers and students who entered legally and trusted the system, the policy could create a two tier process where only those with money can move forward. Critics say it looks like a way to compensate for the administration’s overspending, especially with Ice detaining hundreds of thousands of people, including many with no criminal record.
