Around 9:02 AM on May 11, 2023, Deputy Logan W. Brown of the Logan County Sheriff’s Office was dispatched to the area of SR 638 and CR 101 based on reports of a suspicious black male walking around. The black male, identified as Marcel Shazier, was found by Deputy Brown on SR 638 north of CR 5. He told the Deputy that he was walking towards his girlfriend’s house down the street, and that he was waiting for her to pick him up. The Deputy agreed to give Marcel a ride to the residence to inquire further. Upon approaching the residence, Deputy Brown observed his girlfriend, 39-year-old Jessie Stevens, exit from a Chevy Tahoe while holding a bowl of cereal.

Deputy Brown asked Jessie if she had consumed alcohol, but she denied being under the influence. He subsequently asked her to tilt her head upwards, and he observed a residue of a white powder in her nostrils. She insisted that her unsteady gait was the result of her being tired. Based on his suspicion of impairment as she was attempting to operate a motor vehicle, he afforded Jessie an opportunity to perform standardized field sobriety exercises.

The first exercise was the Modified Romberg Balance Test, and Jessie displayed a circular sway of approximately 2 inches and took 21 seconds to estimate 30 seconds. The second exercise was the Horizontal Gaze Nystagmus (HGN) test. During this test, Deputy Brown observed a lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation. He did not observe the onset of nystagmus prior to 45 degrees or vertical gaze nystagmus. The third exercise involved the Walk and Turn test. During the Walk and Turn test, Jessie was unable to walk in a straight line or count her steps out loud, and she made an improper turn as she pivoted. The final exercise involved the One Leg Stand test, and Jessie did not raise her foot in the proper fashion almost falling over as she stumbled backwards.

Based on her attempt to operate a motor vehicle (physical control) and her inability to adequately perform the field sobriety exercises, Deputy Brown placed Jessie under arrest for Physical Control of a Motor Vehicle. After she was placed under arrest, Deputy Miller searched her and informed her father through another woman’s phone that Jessie was going to be transported to the Logan County Jail in Bellefontaine, Ohio. Her father told the Deputy that Marcel was not welcome on his property. He asked the Deputy to instruct Marcel to gather his belongings and not return to the residence in the future.

Deputy Miller informed Marcel that he had to leave the premises and he asked dispatch to convey this message to Marcel’s probation officer. Two additional deputies arrived on scene to assist Deputy Miller as Jessie was being arrested, but there were no physical altercations. Once she was booked into the Logan County Jail, Jessie admitted to having snorted Neurontin earlier but refused to submit to chemical testing to check for alcohol impairment.
