Repeat DWI Offender Arrested for DWI with her Daughter in the Car

Around 11:06 PM on July 16, 2022, Officer Kevin Pisano of the Denville Township Police Department observed a 2019 Hyundai driving erratically on Route 10 West. Officer Pisano proceeded to initiate a traffic stop by activating his lights. The driver of the vehicle, 26-year-old Stephanie Aguilar, pulled into the parking lot of the Joyce Honda dealership. He noticed that her daughter (a minor) was sitting in the passenger seat of the vehicle, and proceeded to ask her where she was coming from and whether she had consumed any alcohol. She admitted to consuming alcohol, and Officer Pisano subsequently asked her to exit the vehicle. Officer Christopher Ordway arrived at the scene shortly afterwards to assist.

Based on his suspicion of impairment, Officer Pisano offered Stephanie the opportunity to perform field sobriety exercises. The first exercise involved the Walk and Turn test, and Stephanie failed to walk heel-to-toe or turn as instructed. The second exercise was the One Leg Stand test, and Stephanie failed to raise her foot in the proper fashion. The final exercise involved the Horizontal Gaze Nystagmus test, and it was performed by Officer Ordway.

Based on her excessive speeding, erratic driving patterns, and her inability to perform the field sobriety exercises, Officer Pisano placed Stephanie under arrest for driving under the influence. After she was placed under arrest, her vehicle was searched and impounded for a mandatory 12-hour period as required by John’s Law. Stephanie was transported by Officer Pisano to the Denville Township Police Headquarters. Once at police HQ, he read her the Miranda rights as well as the Standard Statement for Motor Vehicle Operators. Stephanie agreed to provide breath samples.

After Stephanie was processed, she was released to her husband after he signed the Potential Liability Warning form on her behalf. Officer Pisano wrote her the following summonses: Operating a motor vehicle under the influence of alcohol with a minor passenger, driving while intoxicated, reckless driving, careless driving, improper passing on right, and failure to maintain lane.

Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
