Mom Arrested for OVI (0.369% BAC) after Crashing Van with 5 Kids

At 6:06 PM on December 17, 2022, officers with the Green Township Police Department were called to the scene of a motor vehicle accident involving a 2021 Honda Odyssey on Haft Road southbound. As officers arrived on scene, they noticed that the Honda had apparently failed to navigate a curve and struck the guardrail on the left side of the road. Officer Ben Dorsey was the first to make contact with the driver and her 5 passengers on the lawn of a nearby residence. The driver was identified as 40-year-old Melissa Frampton, and she was transporting her 12-year-old daughter along with one 14-year-old, two 12-year-olds, and a 13-year-old.

Officer Dorsey asked Melissa to step away from the children so he could talk to Melissa, and asked her if she had been drinking. Melissa admitted to consuming wine in the hours prior before driving the van with 5 kids inside. She attributed her decision to her struggle with alcoholism. Officer Dorsey offered her an opportunity to participate in field sobriety exercises, but Melissa refused. Based on the car accident, her admission to consuming alcohol, and her refusal to participate in field sobriety exercises, he placed Melissa under arrest for operating a vehicle impaired (OVI). None of the children were injured, and they were ultimately released to their parents after the officers took down their names, phone numbers, and dates of birth.

Following her arrest, Officer Dorsey transported Melissa to the Green Township Police Department for further processing. At police HQ, he read Melissa BMV form 2255, and she agreed to submit breath samples. Her Intoxilyzer results indicated a BAC of 0.369%, which is more than FOUR TIMES THE LEGAL LIMIT of 0.08%. Melissa also agreed to waive her Miranda rights and answered a few questions from the officers.

Once the officers were finished with their paperwork, Officer Dorsey escorted Melissa back to the patrol car and transported her to the Hamilton County Justice Center to be booked. The jail initially refused to book her until she obtained a medical clearance from the hospital because she had been in an auto accident with airbag deployment. Officer Dorsey subsequently transported Melissa to UC Health in Cincinnati, where she was evaluated by the hospital and released. After he obtained a medical clearance, Melissa was eventually booked into the jail for OVI along with 5 counts of endangering children.

Court records indicate that Melissa was released on bond 2 days later on December 19, 2022. After a few months, Melissa eventually pleaded guilty to OVI on July 17, 2023, and her other charges were modified or dismissed. She was given a suspended sentence of 175 days, ordered to spend 5 days in a Driver Intervention Program, issued a 2-year driver's license suspension, required to use an ignition interlock device for the next 3 years, and pay a total of $510 in fines.
