Woman in Xena Costume Arrested for DUI in Pullman, WA

On October 29, 2023 at approximately 1:29 AM, Officer Luv St. Andre with the Pullman Police Department observed a 2012 Chevy Cruze fail to stop at a stop sign in the 800 block of NE Opal Street. The vehicle proceeded eastbound on NE Colorado Street, and Officer St. Andre initiated a traffic stop. Upon realizing that he was pursuing the wrong vehicle, he momentarily deactivated his emergency lights, turned southbound on NE B Street, and saw the Chevy Cruze heading in the wrong direction on NE Linden Street. He activated his emergency lights again and stopped the Chevy Cruze at NE Campus Street and NE Thatuna Street. He proceeded to make contact with the driver, who was later identified as 22-year-old Maggie Rash.

After he made contact with Maggie, asked her if she knew why she was being stopped or if she remembered running through the stop sign. Maggie told the officer that she was driving her boyfriend’s car and was unable to provide any identification. Officer St. Andre noticed that Maggie’s eyes indicated signs of impairment and he asked her how much she had been drinking. Maggie initially said “not very much,” but later admitted to consuming three drinks. Based on his suspicion of impairment, Officer St. Andre asked Maggie to exit the vehicle and offered her an opportunity to participate in field sobriety exercises.

The first exercise was the Horizontal Gaze Nystagmus (HGN) test, and Officer St. Andre observed a lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation. The second exercise was the Walk and Turn test. During the Walk and Turn test, Maggie did not make heel-to-toe contact on each step and turned improperly. The final exercise was the One Leg Stand test. During the One Leg Stand test, Maggie dropped her foot three times and swayed her arms for balance.

Following the field sobriety exercises, Officer St. Andre offered Maggie an opportunity to take a Preliminary Breath Test (PBT). The results of the PBT indicated that Maggie’s BAC was at 0.188%, which is more than double the legal limit of 0.08%. Based on her inability to perform the field sobriety exercises and the results of the PBT, Officer St. Andre placed Maggie under arrest for driving under the influence. After she was handcuffed, Maggie was placed in the patrol car and transported to the Pullman Police Department for further processing.

Once they were at police HQ, Officer St. Andre advised Maggie of her Constitutional rights and Maggie agreed to waive them and answer questions. He also read the Implied Consent Warning to her, and she agreed to submit breath samples for testing. He began the 20-minute observation period, and Maggie admitted to consuming alcohol in the hours prior. Maggie’s Alcotest results indicated a BAC of 0.206% (lowest IR result).

After Officer St. Andre was finished with administering the breathalyzer, he placed Maggie in a cell. Following a brief holding period, Maggie was removed from the cell to be photographed and fingerprinted. Officer St. Andre cited Maggie under RCW 46.61.502 for driving under the influence and released her pending a court appearance in Colfax.
