Woman Kicks Deputies during DUI Arrest

Future Arrest

Around 1:50 PM on January 2, 2023, Deputy Clarise Pea with the Santa Rosa County Sheriff’s Office observed a Chevrolet with a malfunctioning brake light swerving over the fog line multiple times on Floridatown Road northbound. As the driver turned left on to Highway 90 westbound, Deputy Pea initiated a traffic stop on Highway 90 in front of the Taco Bell. As she made contact with the driver, later identified as Darya, Deputy Pea observed that she exhibited signs of impairment. Darya seemed confused and she was unable to provide Deputy Pea with her insurance information.

Based on her suspicion of impairment, Deputy Pea ordered Darya to exit the vehicle. Other Deputies arrived to assist with this traffic stop, and Darya had to be physically removed from the vehicle because of her lack of cooperation. As Deputy Pea attempted to place handcuffs on Darya, she started resisting arrest and kicked the Deputies. Deputy Pea eventually was able to place the handcuffs on Darya and she was placed in the patrol car. Darya’s vehicle was searched and Deputies found her prescription medication, but there were no open containers of alcohol.

Deputy Pea attempted to read Darya her Miranda rights, but she did not seem to understand what she was being read. After this attempt, Deputy Pea proceeded to transport Darya to the Santa Rosa County Jail for further processing. Her vehicle was towed by JR’s towing.

After they arrived at the jail, Deputy Pea attempted to administer field sobriety exercises in the sally port. Deputy Pea started with the Horizontal Gaze Nystagmus test, but Darya kept turning her head so this test could not be completed. The second field sobriety exercise was the Walk and Turn test, and Darya failed to walk 9 heel-to-toe steps in each direction or turn as instructed. The final exercise was the One Leg Stand test, which Darya refused to complete.

After attempting to perform field sobriety exercises, Darya was taken in for further processing at the jail. Darya was read the implied consent warnings and she initially agreed to submit breath samples, but she refused to cooperate during the administration of the test and it was ultimately logged as a refusal. Darya was also asked to submit a urine sample, but she refused that test as well.

Darya was booked into the Santa Rosa County Jail, charged with driving under the influence (F.S.S. 316.193.1a) and resisting without violence (F.S.S. 843.02), and given a total bond of $3,500. She was issued a citation for DUI, a UTC for no proof of insurance, and a warning for inoperable brake lights.
