34:19Now PlayingAround 12:28 AM on October 7, 2023, Officer Nicholas Windsor with the Delray Beach Police Department observed a westbound 2022 ASPT golf cart running through a red light signal at the intersection of E Atlantic Avenue and NE 7th Avenue. A northbound vehicle on the same road that was about to turn left (westbound) on to NE 7th Avenue had the green signal, but the vehicle had to stop in order to avoid striking the golf cart. Based on this traffic infraction, Officer Windsor began pursuing the golf cart and observed the driver turn right (northbound) on to NE 6th Avenue while swerving back and forth from the travel lane into a marked FDOT bicycle travel lane. He activated his emergency lights to initiate a traffic stop, and the golf cart pulled into the parking lot of 115 NE 6th Ave near the Anthony’s Coal Fired Pizza & Wings restaurant.
Officer Windsor made contact with the operator of the golf cart, who was identified as Loren. Loren was also transporting 2 female passengers and 1 male passenger on the golf cart. As he made contact with Loren, he detected the odor of alcohol and observed an open container of High Noon alcoholic seltzer in the driver cup holder. Loren’s eyes were red and glossy and her speech was slurred. Loren admitted to consuming alcohol prior to operating the golf cart.
He asked Loren for her documentation and returned to his patrol car to run her license. A check of her records indicated that her license was suspended. Officers Stickley, Mitchell, and Swilley would also arrive on scene around this time to assist Officer Windsor. Based on his suspicion of impairment, Officer Windsor asked Loren to perform field sobriety exercises, and Loren agreed to do so. He started with the Horizontal Gaze Nystagmus (HGN) test, followed the by Walk and Turn test, One Leg Stand test, and Modified Romberg Balance Test.
Based on her traffic infraction, the odor of alcohol, her slurred speech, the open container in the cup holder, and her inability to satisfactorily perform the field sobriety exercises, Officer Windsor placed Loren under the arrest for driving under the influence. After she was placed under arrest, she was first transported to the PBSO BAT, and she agreed to submit breath samples. Her 2 breath samples revealed a BAC level of 0.210% and 0.214%, which was more than double the legal limit of 0.08%.
After submitting breath samples, Loren was booked into the Palm Beach County Jail at 5:27 AM and charged with driving under the influence (316.193), failure to stop at a steady red signal (316.075), failure to drive within single lane (316.089), unknowingly operating while suspended (322.34), and open container (316.1936). Later that day, Loren was released at 9:27 AM pending her court appearance.
