Around 10:28 AM on January 29, 2024, officers Jonathan Figueroa and Nathaniel Arocho with the Hoboken Police Department responded to a luxury apartment building located at 900 Monroe Street with a report of a female who was sleeping on the property. Upon arrival, the officers made contact with a maintenance worker. The maintenance worker led the officers to the Monroe Street side of the property. The officers located 37-year-old Jessica Rosewall sleeping on the top landing of a small stairwell that led towards the electrical meters.

Jessica was using a blanket as a partition, and she told the officers that some of the other items there belonged to her friend who was due to return. The officers instructed her to gather her belongings and leave the property. As she was getting ready to leave, they found her to be in possession of a prohibited item. She was subsequently placed under arrest for an alleged violation of 2C:36-2.

After she was placed under arrest, Jessica was searched and transported to police HQ. At police HQ, she was searched in more detail by Officer Jessica Arebalo. Officer Figueroa photographed and fingerprinted her. They charged her under 2C:36-2 and 2C:18-3B (defiant trespass). After Jessica was processed, their court administrator found probable cause and she was committed to the Hudson County Correctional Facility.

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
