Woman Arrested for DUI After Vomiting in her Car

Around 5:45 AM on March 12, 2023, Corporal Banegas with the Jupiter Police Department an SUV run a red light at the intersection of Military Trail and Toney Penna Drive. He initiated a traffic stop, and the vehicle pulled over in front of the Aycock Funeral Home on Military Trail. Officer Luis Rocha arrived as backup shortly afterwards. Corporal Banegas first made contact with the driver, who was identified as 32-year-old Kollin, and he observed indicators of impairment. Officer Rocha then approached the vehicle, and the driver did not seem to understand which documents she had to hand over.

Based on his suspicion of impairment, Officer Rocha asked Kollin to exit the vehicle so he could begin his DUI investigation. As she exited the vehicle, he noticed an open container of White Claw inside the cup holder on the door. Kollin told Officer Rocha that was coming from Johnny Mangos bar, and she had been at Tiki 52 before that. As Kollin was speaking, Officer Rocha detected the odor of alcohol and she admitted to consuming alcohol before operating a motor vehicle.

Officer Rocha started with the Horizontal Gaze Nystagmus (HGN) test, where he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test, and Kollin did not touch heel-to-toe on each step while turning improperly. The third exercise was the One Leg Stand test, and Kollin failed to raise her foot in the proper fashion. The fourth exercise was the finger-to-nose test, and the fifth exercise was the recitation of the alphabet.

Based on her traffic infraction, the odor of alcohol, the open container in her vehicle, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises, Kollin was placed under arrest for DUI. She was transported to the Palm Beach County Breath Alcohol Testing Facility (BAT), where she ultimately refused to provide breath samples. She was later booked into the Palm Beach County Jail and she was charged with driving under the influence (316.193(1)), reckless driving (316.192(12A)), and failure to stop at a red light (316.075(1C2A)).

Court records indicate that Kollin pleaded guilty to reckless driving, while pleading not guilty for the DUI and red light citations. On June 14, 2023, the DUI charge was nolle prossed, adjudication was withheld for the reckless driving charge, and the red light citation was dismissed. Kollin was also sentenced to 12 months of probation and required to use an interlock device for 6 months.
