as posted by the channelAround 9:17 PM on July 30, 2022, Deputy Nicholas Moro with the Kenosha County Sheriff’s Department was dispatched to Benders Bar and Grill on a report of a pickup truck which had struck a utility pole. He arrived on scene around 9:23 PM and noticed that there was a downed utility pole that had been struck by a black Chevy Silverado. He made contact with 2 women nearby and one of them admitted to being the driver of the Chevy that had struck the utility pole. The driver of the vehicle was identified as Kimberly, and she admitted to consuming alcohol while she was on the lake earlier that day.
As Deputy Moro was speaking with Kimberly, he observed indicators of impairment and asked Kimberly to perform field sobriety exercises to prove that she was safe to drive. The first field sobriety exercise involved the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test, and Kimberly failed to touch heel-to-toe on each step and turned improperly. The final field sobriety exercise was the One Leg Stand test. During the One Leg Stand test, Kimberly failed to raise her foot in the proper fashion while putting her foot down multiple times.
Based on her the car accident, her indicators of impairment, her admission to consuming alcohol, and her inability to perform the field sobriety tests adequately, Kimberly was placed under arrest for operating while intoxicated (OWI). This was her third arrest for OWI, and she told the officer in the patrol car that she had celebrated her divorce party earlier that evening before this happened. Kimberly was transported to the hospital for a blood draw, but she refused the blood draw at the hospital. After she refused the blood draw, she placed in the patrol car again until she could be released to a sober adult pending her court appearance.
