Man With a Sailor's Mouth Arrested After Vaping on the Boardwalk

Around 9:14 PM on August 26, 2024, Patrolman Jimenez with the Seaside Heights Police Department was conducting bike patrol on the south end of the boardwalk near Beachcomber Bar & Grill. He and his partner Patrolman Raasch observed a male vaping on the boardwalk, which is prohibited. They informed the male, later identified as 40-year-old Joshua Massei, that vaping was prohibited and that he needed to step down to the street end of Lincoln Avenue and Ocean Terrace so that they could gather his information. At this point, he became irate but reluctantly walked with them towards the street.

As they attempted to gather his information, he began to yell profanities towards the officers and additional officers arrived on scene and attempted to place him under arrest. Patrolman Zilenas advised him that he was being placed under arrest for disorderly conduct, but he continued to resist. They were eventually able to handcuff him, and Patrolmen ZIlenas and DiGiovanni escorted Joshua to the patrol car and placed him inside.

He was transported to the Seaside Heights Police Department for further processing. During the booking process, Joshua was offered medical attention but he declined. Joshua was charged with smoking on the boardwalk (ordinance 33-8O) and disorderly conduct (2C:33-2A(1)). He was released later that night with a summons pending his court appearance.

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
