Man Arrested for DWI After Revving his Engine in Hoboken, NJ

Around 2:30 AM on November 9, 2024, Officers Aaron Font and Valentino Salgado with the Hoboken Police Department observed the driver of a 2006 Acura RSX revving the engine in the vicinity of Newark Street and Bloomfield Street. They continued following the vehicle on Bloomfield Street northbound and activated their emergency lights, and the driver pulled over at the corner of 2nd Street and Bloomfield Street. Officer Font made contact with the driver, who was identified as 24-year-old David.

As Officer Font asked David for his documents, he seemed to be unable to locate all of the necessary documentation. Officer Font detected the odor of alcohol and observed other indicators of impairment. He continued to deny having consumed any alcohol before operating a motor vehicle, but Officer Font instructed him to exit the vehicle and perform field sobriety exercises.

Officer Font started with the Horizontal Gaze Nystagmus (HGN) test, and he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. He did not observe vertical gaze nystagmus. The second exercise was the Walk and Turn test. During the Walk and Turn test, David failed to touch heel-to-toe on each step while turned improperly. The final exercise was the One Leg Stand test, and David failed to raise his foot in the proper fashion and did not count in the correct sequence.

Officer Font once again told him that he could smell the alcohol on his breath, but David continued to deny having consumed any alcohol. Based on the odor of alcohol and his inability to satisfactorily complete the field sobriety exercises, David was placed under arrest. After he was placed under arrest, his vehicle was impounded for a 12-hour hold according to John’s Law. Officer Font transported David to the Hoboken Police Department for further processing. At the station, the Standard Statement for Motor Vehicle Operators was read to him but he refused to submit breath samples. Officer Font issued David the following citations: Operating under the influence, refusal to submit to submit to chemical test, consent to take samples of breath, reckless driving, and noisy muffler

Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
