Around 2:13 AM on August 25, 2024, Officer Andrew Gargaloni with the Mantoloking Police Department was on patrol on Ocean Avenue and he observed a southbound silver 2006 Toyota Highlander speeding. As followed the vehicle, he observed the driver swerving and failing to stay in the lane. He activated his emergency lights to initiate a traffic stop, and the driver pulled over. He notified dispatch about the traffic stop and made contact with the driver, who was identified as 22-year-old Diona.

As he approached Diona, he detected the odor of alcohol. Diona was asked for her documents, and she provided them without issue. She told Officer Gargaloni that she had left Jenks Club in Point Pleasant Beach and that she was headed home. Based on his suspicion of impairment, Diona was eventually asked to perform field sobriety exercises after another officer arrived on scene to assist.

Officer Gargaloni started with the Walk and Turn test, and Diona did not touch heel-to-toe on each step while failing to keep her arms at her sides. The final exercise was the Walk and Turn Test. Diona was unable to raise her foot in the proper fashion and the test was terminated for safety reasons.

Based on her erratic driving, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, Diona was placed under arrest. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John’s Law. Officer Gargaloni transported Diona to the Mantoloking Police Department for further processing. At the station, she was read Standard Statement for Motor Vehicle Operators and she agreed to submit breath samples. Lieutenant Gregory Popaca administered the Alcotest machine. Her Alcotest results indicated a BAC of 0.203%, which was over the legal limit of 0.08%.

After they were finished processing Diona, she was released to a sober adult pending her court appearance after they signed the Potential Liability Warning on Diona’s behalf. Officer Gargaloni issued Diona the following citations: Operating under the influence, careless driving, traffic on marked lanes, and delaying traffic

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
