PBA Cards Fail to Prevent Drunk Woman’s SECOND DWI Arrest

Around 12:35 AM on April 10, 2026, Patrolman Nicholas Massaro with the Middletown Township Police Department observed a 2017 Lexus R35 swerving across lanes in the vicinity of Route 35 and Crestview Drive. He began following the vehicle, and observed the driver continue to swerve. Based on her erratic driving, he eventually activated his emergency lights and initiated a traffic stop in the vicinity of Route 35 and Tindall Road. He exited his patrol car and made contact with the driver, who was eventually identified as Nicole Corbett.

As he started speaking with Nicole, Patrolman Massaro detected the odor of alcohol and observed other indicators of impairment. Nicole admitted to consuming alcohol at a friend’s place earlier that evening. Her friend would later say that they were at Gabriella’s Italian Steakhouse, and that they had consumed a few glasses of wine. Based on his suspicion of impairment, Nicole was eventually asked to exit the vehicle and perform field sobriety exercises.

The first exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Massaro observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. He also detected a Vertical Gaze Nystagmus (VGN), indicating a high level of impairment. The second exercise was the Walk and Turn test. During the Walk and Turn test, Nicole did not touch heel-to-toe on each step, took an incorrect number of steps, and turned improperly. The third exercise was the One Leg Stand test, and Nicole was unable to raise her foot in the proper fashion and failed to count in the correct sequence. The final exercise involved an alphabet test, which Nicole initially failed to complete before later managing to complete the test satisfactorily.

Based on the odor of alcohol, her admission to consuming an alcoholic beverage earlier that evening, and her inability to complete the field sobriety exercises, Patrolman Massaro placed Nicole under arrest for driving under the influence. Her vehicle was impounded for a 12-hour hold according to John’s Law. Patrolman Massaro transported Nicole to the Middletown Township Police Department for further processing. Her friend was also given a courtesy transport to the station.

At the station, Patrolman Massaro read Nicole the Standard Statement for Motor Vehicle Operators, and she agreed submit breath samples. However, she failed to submit adequate breath samples despite multiple attempts and she was ultimately charged with a refusal. After the officers finished processing her, Nicole was released to a sober adult pending her court appearance after they signed the Potential Liability Warning form on Nicole’s behalf.

Patrolman Massaro issued Nicole the following citations:

-Operating under the influence (39:4-50)

-Refusal to submit to chemical test (39:4-50.4A)

-Reckless driving (39:4-96)

-Careless driving (39:4-97)

-Traffic on marked lanes (39:4-88)

-Failure to possess driver insurance card (39:3-29C)

-Tire equipment (39:3-72)

As of June 23, 2026, this case is still pending before the Middletown Township Municipal Court. Nicole has previously been arrested for DWI and resisting arrest (2C:29-2A(1)) in Sea Bright, New Jersey on December 12, 2015.
