"That application from McDonald was converted from a Provisional application on April 30, 2023. Over 15 months ago and the provisional application was filed one year before that date. One could reasonably presume that SIG was aware of this "improvement" becuase of the filing dates and McDonald's prior affiliation with SIG. Also, his sear as shown in Fig 3, uses the patented SIG sear "FIrearm Sear with Multiple Engagement Surfaces". That would generally render his design un-patentable. If my patent has features A,B,C and D for example, the patent covers any of those elements singularly, or in any combination. So, McDonald can use SIG's A and B for example the and E element and not infinge the the prior art. He could probably get a patent for a generic sear with that flange as shown in figure 3 with his thumb safety.
It received a Non-Final rejection by the examiner and the documents showing the current patent assignment to Angled Spade Technologies."
